TULSA, Okla. (AP) — An Indian tribe that hoped to open a casino in Broken Arrow is asking a federal judge to allow them to build a sports bar and music venue instead.
The Kialegee Tribal Town filed a motion Wednesday, asking U.S. District Judge Gregory Frizzell to modify an injunction issued May 18 that prohibits the tribe from building on the site.
The judge found the tribe didn't have jurisdiction to build its Red Clay Casino at the site. Frizzell ruled the land belonged to two members of the Muscogee Creek Nation — not the Kialegee. But the tribe wrote in its motion Wednesday that the two members have since been enrolled as members of Kialegee Tribal Town.
Last week, the National Indian Gaming Commission ruled the site is ineligible for gambling.
