Attorney Files Legal Challenge to Oklahoma Tax Cut

OKLAHOMA CITY (AP) — An Oklahoma City attorney with a long track record of successfully challenging legislative actions as unconstitutional has filed a lawsuit claiming a bill passed by the Legislature to cut the income tax violates the Oklahoma Constitution.

Attorney Jerry Fent filed the lawsuit Thursday with the Oklahoma Supreme Court.

Fent alleges that the bill includes multiple subjects and violates the state Constitution's prohibition on "logrolling" more than one subject into a single bill. Besides cutting the income tax rate, beginning in 2015, the bill also diverts $120 million of income tax collections over the next two years to pay for repairs to the state Capitol.

Governor Mary Fallin's spokesman Alex Weintz says the governor and her legal counsel believe the law is constitutional and "similar to many other laws affecting revenue."
