TULSA, Okla. (AP) — A Tulsa County judge has rejected a motion to dismiss one of two criminal misdemeanor charges against former Tulsa County Sheriff Stanley Glanz.
Glanz's attorneys asked that the charge of refusing to perform official duties in which a grand jury alleged Glanz failed to turn over a 2009 memo questioning the qualifications of reserve deputy Robert Bates be dropped. Defense attorneys say the memo was a personnel investigation and was confidential under state law.
Judge Rebecca Nightingale ruled Friday that the memo was an investigation of the reserve deputy program, not a personnel investigation.
Glanz is also charged with willfully violating the law. He has yet to enter a plea.
The grand jury investigated Glanz after Bates shot and killed an unarmed man. Bates has pleaded not guilty to second-degree manslaughter.
